The present general terms and conditions of sale, to the exclusion of all others, govern the contractual relations between PHARMACIE DE MAILLOLES and any non-commercial individual consulting the website accessible at the address "www.soin-et-nature.com" and/or wishing to purchase a product offered for sale on the said site.

Each term or expression hereinafter used, when capitalized herein, shall have the following meaning:
5.1. General
The PHARMACY ensures that the PRODUCT descriptions proposed on the PRODUCT SHEET of each PRODUCT enable the USER to know the essential characteristics of the PRODUCTS before placing a definitive order.
It is the USER's responsibility to ensure, prior to any order, that the PRODUCTS he/she wishes to purchase correspond to these needs and expectations and, in particular, to ensure that he/she does not present any incompatibility or allergy with the components of the product.
Minors under the age of 16 are not authorized to purchase medicines on the site.
PHARMACIE is careful not to offer counterfeit products or products that do not meet current standards.
If, despite the care taken by the PHARMACIE in describing the PRODUCTS, an error should occur in the description of the essential characteristics of the PRODUCTS, the PHARMACIE undertakes to reimburse the PRODUCT(S) in question under the conditions set out in articles 17 and 18.
As the presentation and/or packaging of the PRODUCTS offered for sale on the SITE are not among the essential characteristics of said PRODUCTS, the photographs representing the various PRODUCTS and SPECIFIC PREPARATIONS published on the SITE are given for information purposes only and are non-contractual.
The sale of products from the "Cosmétique Active France" companies: La Roche Posay, Vichy, Skinceutical, Sanoflore and Roger & Gallet, is limited to visitors to the site who are established or resident in the European Economic Area as defined below or in the territories of the European Free Trade Association (Norway, Switzerland, Iceland and Liechtenstein).
PHARMACIE will not be able to honour any sale to a country outside this economic area containing products from this laboratory. Any sale made and/or validated notwithstanding the foregoing shall be immediately cancelled in its entirety, without compensation.
The sale of products from this laboratory is limited to six (6) identical products per day, per order and/or per person. Any request for delivery exceeding this number will be refused and the supplier will be informed. Product sales are reserved to individuals for their own personal use and consumption, and to authorized distributors.
Sales of all "Pierre Fabre Dermo Cosmétique" ranges: Avène thermal spring water, A-Derma, Ducray, Klorane, Elancyl, René Furterer, are limited to the European Economic Area as defined below. No sale to a country outside this economic area containing products from this laboratory will be honored by PHARMACIE. Any sale made and/or validated notwithstanding the foregoing shall be immediately cancelled in its entirety, without compensation.
This laboratory limits the sale of its products to 6 identical references sold to the same end-user over a period of 15 consecutive days. We are obliged to inform Pierre Fabre Dermo Cosmétique of any delivery requests exceeding this number. Product sales are reserved to individuals for their own personal use and consumption and to authorized distributors.
European Economic Area: Austria, Belgium, Bulgaria, Cyprus (Greek part), Czech Republic, Denmark, Estonia, Finland, France, Germany, Greece, Hungary, Ireland, Italy, Latvia, Luxembourg, Malta, Netherlands, Poland, Romania, Slovakia, Spain, Sweden, Liechtenstein, Norway, United Kingdom.
5.2. Foreign orders
Any order of a PRODUCT to a country other than METROPOLITAN FRANCE, is under the entire responsibility of the USER. The USER undertakes, prior to any order, to inform himself/herself of the restrictions in force and the law applicable in the territory where the PRODUCT is received. In this respect, it is the USER's responsibility to ensure that he/she can freely purchase the PRODUCT in the territory where the PRODUCT is received.
No medicine will be delivered outside France. Only available for collection at the pharmacy in Perpignan (France).
The prices of the PRODUCTS as indicated on the product sheets are indicated in euros and include all taxes for France and the European Union and exclude shipping costs.
In the event of a typing or calculation error revealing a manifestly derisory price, the PHARMACIE reserves the right not to honour the order and to reimburse the USER, where applicable, within a maximum period of 30 days.
In the case of SPECIFIC PREPARATION, the price is communicated to THE USER in accordance with article 12 of the present rules.
PHARMACIE reserves the right to charge different prices in the pharmacy and on the SITE.
In the event of an order for a PRODUCT destined for a country other than METROPOLITAN FRANCE, the USER acknowledges that he/she is an importer of the products concerned and shall be personally responsible to the competent authorities for all declarations and payment of any taxes that may be due, in particular customs duties.
6.1. Compulsory Health Insurance Fund
The USER is expressly informed and accepts that no health insurance form will be provided for PRODUCTS ordered on the SITE. Therefore, no reimbursement can be made by the French "Caisse d'Assurance Maladie Obligatoire".

The USER shall not be entitled to any compensation as a result of this unavailability.
Delivery times depend on the delivery method chosen by the USER.
The approximate delivery date of a PRODUCT according to the delivery method is mentioned in step 4 of the order process.
However, when, in the same order, several PRODUCTS have different approximate delivery dates, the approximate delivery date of the whole order corresponds to the approximate delivery date of the PRODUCT whose delivery date is furthest away.
This approximate delivery date for the entire order is indicated in the order confirmation.
In the case of SPECIFIC PREPARATION, the delivery deadline is specified to the USER in accordance with article 12 herein.
Each USER wishing to place an order for PRODUCTS on the SITE must first have created an account on the SITE and be identified.
When ordering for the first time, the USER must first follow the procedure for creating an account.
During the account creation procedure, the USER chooses a password.
This password is personal and is kept by the USER under his responsibility. Any loss or omission must be reported to PHARMACIE as soon as possible, by filling in the form provided on the SITE.
The USER may place an order online from the SITE.
The order can only be registered on the SITE if the USER is identified by entering his e-mail address and the password he has chosen.
USERS wishing to place an order must first add the PRODUCTS they wish to purchase to their basket by clicking on the "add to basket" button .
The USER may, at any time, access and modify the contents of his basket by clicking on the link "currently (number of items) in my basket".
If the USER wishes to validate his or her basket and thus confirm his or her order, he or she must click on the "complete my order" button.
The USER must then follow the order procedure, indicating the requested billing and delivery information.

PHARMACIE carries out a feasibility check and reserves the right to refuse to carry out a SPECIFIC PREPARATION, particularly in the event of contraindication to the desired mixture.
Within a maximum of two working days from receipt of the request, PHARMACIE will send an e-mail:
Either to inform THE USER that the SPECIFIC PREPARATION requested cannot be carried out;
Or to offer the USER a quote for the SPECIFIC PREPARATION requested.
In the latter case, the USER will be offered a quotation indicating the price of the SPECIFIC PREPARATION, excluding VAT and including VAT, and the delivery time after validation. The USER must give his written approval by return e-mail to validate his request for a personalized formula. It is reminded that a Good For Agreement commits his order and in accordance with the exclusions of the article L.221-28 of the Code of consumption (see article 19) this product could neither be taken back nor exchanged.
After sending the order form by e-mail, a clickable link is sent to the user who, after identification, adds the requested SPECIFIC PREPARATION to the basket.
The quote is valid for one month from the date of issue.
The USER may add other products to the basket.
The USER may, at any time, access the contents of his basket and modify it by clicking on the "my basket" link .

It is expressly agreed that, barring obvious error on the part of the PHARMACIE, the data stored in the PHARMACIE's computer systems have evidential value with regard to orders placed by the USER. Data on computer or electronic media constitute valid proof and, as such, are admissible under the same conditions and with the same probative force as any document drawn up, received or kept in writing.
Purchase orders and invoices are archived on a reliable and durable medium so as to correspond to a faithful and durable copy in accordance with article 1348 of the French Civil Code.
Once the order has been validated, PHARMACIE will send the USER confirmation of the order by e-mail to the e-mail address indicated in the USER's account.
The progress of the order can be tracked by the USER from his customer account on the SITE.
Payment shall be made in accordance with the terms and conditions of the order. All purchases are payable in cash and without discount when the order is placed. PHARMACIE also reserves the right to invoice the purchaser for any bank charges and agios it may incur as a result of the purchaser issuing means of payment that do not enable the seller to collect its debt.

PHARMACIE reserves the right to interrupt or cancel a transaction for any legitimate reason, in particular in the event of suspected fraud or in the event of an outstanding payment.
In the absence of payment confirmation, the order will be cancelled and the USER will be informed by e-mail.
Payment by credit card by telephone is not accepted, but the USER may be guided by telephone through the ordering process.

If the cheque is not received by the PHARMACIE within two months, the order will be cancelled.
If the product becomes unavailable during this period, the order will be cancelled in accordance with article 8 herein.

Your order will be validated on receipt of the transfer.
The USER has the choice of having his order delivered either to his home address, or to another address of his choice, indicated during the ordering procedure.
The USER communicates the delivery address under his sole responsibility. In the event that the PRODUCT cannot be delivered due to an error in the address made by the USER, or in the event that the USER does not collect the PRODUCT in due time, the PRODUCT will be returned to the PHARMACY.
In such cases, the USER shall be informed and may request a second delivery, with the cost of the second shipment to be borne by the USER.
Failing instructions within 10 days of the PRODUCT's return, the order will be cancelled and the USER reimbursed.
Delivery charges are indicated in article 7 herein.
The delivery deadline indicated is valid for immediate payment of the order by credit card.
In the case of payment by cheque, the delivery deadline will be deferred by the time required to receive and cash the cheque.
In the case of payment by PAYPAL, the delivery deadline will be deferred by the time required for PAYPAL to confirm payment.
In the event of payment by bank transfer, the delivery deadline will be deferred by the time required for receipt of the transfer.
Upon receipt, it is the USER's responsibility to check the merchandise and, if necessary, to note any reservations on the delivery note. In case of doubt, the words"goods totally damaged" must be written on the deliveryman's receipt.
Acceptance is deemed to have taken place when the USER or any third party designated by the USER receives the PRODUCTS. In this respect, the parties acknowledge that the delivery control and tracking system provided by the carrier is authoritative.
If the package has been delivered damaged directly to the USER'S mailbox, the USER must return it (without opening it) to the nearest post office to refuse delivery.
If no reservations are made on the delivery note, the PRODUCTS are presumed to be in conformity and free of apparent defects. The words "subject to unpacking" are null and void.

After verification by the PHARMACIE and in the event that the non-conformity or error is attributable to an error by the PHARMACIE, the PHARMACIE will cover the cost of returning the PRODUCT and will replace it as soon as possible.
19.1. Right of withdrawal
For PRODUCTS other than PREPARATIONS and SPECIFIC PREPARATIONS, and in accordance with Article L.121-21 of the French Consumer Code, the USER has a period of fourteen (14) days to exercise his or her right of withdrawal without having to justify his or her reasons or pay any penalties, with the exception, where applicable, of the cost of returning the goods.
The fourteen (14) day period runs from the time the USER receives or collects the products ordered. Any exercise of the right of withdrawal outside this period will not be accepted.
If the period expires on a Saturday, Sunday, public holiday or non-working day, it is extended to the next working day.

The direct costs of returning the goods shall be borne by the USER.
The PHARMACIE will reimburse the USER for all payments received for the order, including delivery costs (with the exception of additional costs arising from the fact that the USER has chosen, where applicable, a delivery method other than the less expensive standard delivery method proposed by the PHARMACIE), without undue delay, and no later than fourteen (14) days from the day on which the PHARMACIE is informed of the USER's decision to withdraw.
The PHARMACY reserves the right to defer reimbursement until receipt of the returned PRODUCTS or until the USER provides proof of shipment of the PRODUCTS, whichever comes first.
The PHARMACY will reimburse the USER using the same means of payment as that used by the USER for the initial transaction, unless the USER accepts a different means. In any event, this refund will not incur any costs for the USER.
19.2 Exclusion of the right of withdrawal
In accordance with the provisions of article L.221-28 of the French Consumer Code, the right of withdrawal is excluded for the products referred to in the said article, and more specifically in its 3° to 5°):
"[The] supply of goods made to the consumer's specifications or clearly personalized ;
"Goods that are likely to deteriorate or expire rapidly.
"Goods which have been unsealed by the consumer after delivery and which cannot be returned for reasons of hygiene or health protection".
Therefore, no right of withdrawal shall apply to medicines* or products with a short shelf life (3 months) and to the specific preparations referred to in article 19 of these terms and conditions.
*In order to prevent counterfeit medicines or medicines that have not been stored under the conditions mentioned above from entering the medicines circuit, this prohibition on the right of withdrawal for medicines was confirmed by the decree of June 20, 2013.
Similarly, no right of withdrawal may be applied in particular to the following PRODUCTS if they have been unsealed:
20.1. PREPARATIONS are made by the PHARMACY and are delivered sealed.
Due to their nature, in particular the impossibility of putting them back on sale if they are returned unsealed for health reasons, and in application of the provisions of article L.221-28, PREPARATIONS may not be the subject of a right of withdrawal once unsealed and are covered by article 19.2 hereof.
Consequently, the right of withdrawal only applies to sealed PREPARATIONS under the conditions set out in article 19 hereof.
20.2. Pursuant to the provisions of 3°) of article L.221-28 of the French Consumer Code, SPECIFIC PREPARATIONS are "goods made to the consumer's specifications or clearly personalized". As such, SPECIFIC PREPARATIONS are not subject to any right of withdrawal.
All PRODUCTS offered on the SITE are subject to the warranty for hidden defects provided for in articles 1641 et seq. of the French Civil Code.
For items delivered defective, the USER benefits from a warranty allowing him to return them in accordance with articles L.211-4 and following of the French Consumer Code.
Pursuant to Article 3 of the Decree of December 18, 2014, it is recalled that the consumer, when acting in legal warranty of conformity:

Data retention period
LA PHARMACIE retains data for a period of five years from the end of the relationship with the customer or prospect.
