The PHARMACY ensures that the descriptions of the PRODUCTS provided on the PRODUCT PAGE for each PRODUCT enable the USER to understand the essential characteristics of the PRODUCTS before placing a final order.
It is the USER’s responsibility to ensure, prior to placing any order, that the PRODUCTS they wish to purchase meet their needs and expectations and, in particular, to ensure that they have no incompatibilities or allergies to the product’s ingredients.

The PHARMACY takes care not to offer counterfeit products or products that do not meet current standards.
If, despite the PHARMACY’s care in describing the PRODUCTS, an error occurs in the description of the essential characteristics of the PRODUCTS, the PHARMACY agrees to refund thePRODUCT(S) in question under the conditions set forth in Articles 17 and 18.
Since the presentation and/or packaging of the PRODUCTS offered for sale on the SITE do not constitute essential characteristics of said PRODUCTS, the photographs depicting the various PRODUCTS and SPECIFIC PREPARATIONS published on the SITE are provided for informational purposes only and are not binding.
The sale of products from the company “Cosmétique Active France”: La Roche-Posay, Vichy, Skinceuticals, Sanoflore, and Roger & Gallet, is limited to visitors to the site who are established or reside in the European Economic Area as defined below or in the territories of the European Free Trade Association (Norway, Switzerland, Iceland, and Liechtenstein).
The PHARMACY cannot fulfill any order destined for a country outside this economic area that contains products from this laboratory. Any sale made and/or confirmed notwithstanding the foregoing will be immediately canceled in its entirety, without compensation.
Sales of this laboratory’s products are limited to six (6) identical products per day, per order, and/or per person. Any delivery request exceeding this limit will be refused, and the supplier will be notified. The PHARMACY will not honor any sale destined for a country outside this economic area that contains products from this laboratory. Any sale made and/or confirmed notwithstanding the foregoing will be immediately canceled in its entirety, without compensation.
This laboratory limits the sale of its products to 6 identical items sold to the same end user over a period of 15 consecutive days. We are required to notify Pierre Fabre Dermo Cosmétique of any delivery requests exceeding this limit. Product sales are restricted to individuals for their personal use and consumption and to authorized distributors.
European Economic Area: Germany, Austria, Belgium, Bulgaria, Cyprus (Greek part), Denmark, Spain, Estonia, Finland, France, Greece, Hungary, Ireland, Italy, Latvia, Luxembourg, Malta, the Netherlands, Poland, Czech Republic, Romania, United Kingdom, Slovakia, Sweden, Liechtenstein, Norway.
5.2. International Orders
Any order for a PRODUCT destined for a country other than METROPOLITAN FRANCE is the sole responsibility of the USER. The USER agrees, prior to placing any order, to familiarize themselves with the restrictions in effect and the applicable law in the territory where the PRODUCT will be received. As such, it is the USER’s responsibility to ensure that they are permitted to freely purchase the PRODUCT in the territory where it will be received.
No medications will be shipped outside of France. Available for pickup only at the pharmacy in Perpignan (France).
The prices of the PRODUCTS, as indicated on the product pages, are listed in euros and include all taxes for France and the European Union, excluding shipping costs.
In the event that a data entry or calculation error results in a price that is manifestly unreasonably low, the PHARMACY reserves the right not to fulfill the order and to refund the USER, if applicable, within a maximum of 30 days.
In the case of a SPECIFIC PREPARATION, the price is communicated to the USER in accordance with Article 12 of these terms and conditions.
The PHARMACY reserves the right to charge different prices in-store and on the SITE.
In the event of an order for a PRODUCT destined for a country other than METROPOLITAN FRANCE, the USER acknowledges that they are the importer of the products in question and assumes full personal responsibility, before the competent authorities, for all declarations and payment of any taxes that may be due, including customs duties.
6.1. Mandatory Health Insurance Fund
The USER is expressly informed and agrees that no treatment form will be provided for PRODUCTS ordered on the SITE. Consequently, no reimbursement will be covered by the French Mandatory Health Insurance Fund.

Delivery times depend on the shipping method selected by the USER.
The estimated delivery date for a PRODUCT, based on the delivery method, is indicated in Step 4 of the ordering process.
However, when multiple PRODUCTS in the same order have different estimated delivery dates, the estimated delivery date for the entire order corresponds to the estimated delivery date of the PRODUCT with the latest delivery date.

In the case of SPECIAL PREPARATION, the delivery deadline is specified to the USER in accordance with Article 12 herein.
Any USER wishing to place an order for PRODUCTS on the SITE must first have created an account on the SITE and be logged in.
When placing their first order, the USER must first follow the account creation procedure.
During the account creation process, the USER selects a password.
This password is personal and is the USER’s sole responsibility. Any loss or forgetfulness must be reported to the PHARMACY as soon as possible by filling out the form provided on the SITE.
The USER may place an order online via the SITE.
The order can only be placed on the SITE if the USER logs in by entering their email address and the password they have chosen.
A USER who wishes to place an order must first add the PRODUCTS they wish to purchase to their shopping cart by clicking the“Add to Cart” button.
The USER may, at any time, view the contents of their shopping cart and modify it by clicking on the link“Currently (number of items) in my shopping cart.”

The request must specify the exact formula desired.
The PHARMACY will assess feasibility and reserves the right to refuse to produce a SPECIFIC PREPARATION, particularly in the event of a contraindication to the desired mixture.
Within a maximum of two business days from receipt of the request, the PHARMACY will send an email:
Either to inform the USER that the requested SPECIFIC PREPARATION cannot be produced;
Or to provide the USER with a quote for the requested SPECIFIC PREPARATION.
In the latter case, a quote specifying the price of the SPECIFIC PREPARATION both excluding and including tax, as well as the delivery time after approval, is provided to the USER. The USER must provide written approval via return email to confirm their request for a customized product. Please note that a written approval confirms the order, and in accordance with the exclusions set forth in Article L.221-28 of the French Consumer Code (see Article 19), this product cannot be returned or exchanged.
After sending their written consent via email, the User will receive a clickable link; once logged in, they can add the requested SPECIFIC PREPARATION to their cart.
The quote is valid for one month from the date of issuance.
The USER may add other products to their shopping cart.
The USER may, at any time, view the contents of their shopping cart and modify it by clicking on the“My Cart” link.

It is expressly agreed that, unless there is a manifest error on the part of the PHARMACY, the data stored in the PHARMACY’s computer systems shall constitute conclusive evidence regarding orders placed by the USER. Data stored on computer or electronic media constitutes valid evidence and, as such, is admissible under the same conditions and with the same probative value as any document that would be drawn up, received, or retained in writing.
Purchase orders and invoices are archived on a reliable and durable medium so as to constitute a faithful and durable copy in accordance with Article 1348 of the Civil Code.
After the order is confirmed, the PHARMACY will send the USER an order confirmation via email to the email address provided in their account.
The USER can track the status of the order from their customer account on the SITE.
Payment is made in accordance with the terms specified at the time of the order. All purchases are payable in full and without discount at the time of the order. The PHARMACY further reserves the right to bill the buyer for any bank fees and surcharges the buyer may incur as a result of using payment methods that prevent the seller from collecting the amount owed.

This system ensures a high level of confidentiality; the credit card number, expiration date, and the last three digits of the security code are always encrypted so they are never displayed. All transactions activate the 3D Secure feature, which systematically requires a confirmation code. This confirmation code is typically sent via text message to the cardholder’s cell phone. Orders may be paid by credit card, Visa, or Mastercard. The USER’s bank account will be debited within a maximum of 24 hours following the order date, and the order will be considered complete upon confirmation of approval by the payment processing centers.
The PHARMACY reserves the right to suspend or cancel a transaction for any legitimate reason, particularly in the event of suspected fraud or an outstanding balance that has not been settled.
If payment is not confirmed, the order will be canceled, and the USER will be notified by email.
Credit card payments by phone are not accepted, but the USER may receive telephone assistance to complete their order.

If the check is not received by the PHARMACY within two months, the order will be canceled.

Your order will be confirmed upon receipt of the transfer.
The USER may choose to have the order delivered either to their home or to another address of their choice, as specified during the ordering process.
The USER is solely responsible for providing the delivery address. If the PRODUCT cannot be delivered due to an error in the address provided by the USER, or if the USER fails to pick up the PRODUCT in a timely manner, the PRODUCT will be returned to the PHARMACY.
In such cases, the USER will be notified and may request a second delivery, with the USER being responsible for the shipping costs of the second shipment.
If no instructions are received within 10 days of the PRODUCT’s return, the order is canceled and the USER is refunded.
Delivery charges are specified in Article 7 of these Terms.
The specified delivery deadline applies only if the order is paid for immediately by credit card.
In the event of payment by check, the delivery deadline will be extended by the time required to receive and clear the check.
If payment is made via PayPal, the delivery deadline will be extended by the time required for PayPal to confirm the payment.
If payment is made by bank transfer, the delivery deadline will be extended by the time required to receive the transfer.
Upon receipt, it is the USER’s responsibility to inspect the goods and, if necessary, note any reservations on the delivery slip. The phrase “goods completely damaged” must be written on the delivery person’s receipt in case of doubt.
Receipt is deemed to have occurred when the USER or any third party designated by the USER receives the PRODUCTS. In this regard, the parties acknowledge that the delivery tracking and monitoring system provided by the carrier is conclusive.
If the package was delivered damaged, directlyinto the USER’s mailbox, the USER must return it (without opening it) to the nearest post office to refuse delivery.
Unless reservations are noted on the delivery slip, the PRODUCTS are presumed to be in compliance and free from apparent defects. It is specified that the notation “subject to unpacking” is void.

After verification by the PHARMACY, and if the non-conformity or error is attributable to an error on the part of the PHARMACY, the PHARMACY will cover the cost of returning the PRODUCT and will replace it as soon as possible.
19.1. Right of Withdrawal
For PRODUCTS other than PREPARATIONS and SPECIFIC PREPARATIONS, and in accordance with Article L.121-21 of the Consumer Code, the USER has a period of fourteen (14) days to exercise their right of withdrawal without having to provide a reason or pay any penalties, except, where applicable, for return shipping costs.
The fourteen (14)-day period begins on the date the USER receives or picks up the ordered products. Any exercise of the right of withdrawal outside this period will not be accepted.
If the period expires on a Saturday, Sunday, public holiday, or non-working day, it is extended until the next business day.
A USER wishing to exercise their right of withdrawal must send the PHARMACY, before the expiration of the period specified above, an unambiguous statement expressing their intention to exercise their right of withdrawal to the following address:

In accordance with Article L.221-23 of the French Consumer Code, the USER must return, within fourteen (14) days of notifying the PHARMACY of their decision to exercise their right of withdrawal, the PRODUCT(S), properly protected and clearly marked with the order number, in their original packaging, in perfect condition (having suffered no deterioration other than that necessary to establish the nature, the characteristics, and proper functioning of the PRODUCT—failure to do so may result in the USER being held liable—and accompanied by its (their) accessories and documentation to the following address:

The direct costs of returning the item are the responsibility of the USER.
The PHARMACY will refund the USER all payments received for the order, including shipping costs (except for any additional costs resulting from the USER’s choice, if applicable, a delivery method other than the least expensive standard delivery method offered by the PHARMACY), without undue delay, and no later than fourteen (14) days from the day the PHARMACY is notified of the USER’s decision to withdraw.
The PHARMACY reserves the right to defer the refund until it receives the returned PRODUCTS or until the USER provides proof of shipment of the PRODUCTS, whichever occurs first.
The PHARMACY will refund the USER using the same payment method the USER used for the initial transaction, unless the USER agrees to a different method. In any event, this refund will not incur any costs for the USER.
19.2. Exclusion of the Right of Withdrawal
In accordance with the provisions of Article L.221-28 of the Consumer Code, the right of withdrawal is excluded for the products referred to in said article, specifically in paragraphs 3° through 5°):
“[The] supply of goods made to the consumer’s specifications or clearly personalized;
“[Goods] that are liable to deteriorate or expire rapidly;
“Goods that have been unsealed by the consumer after delivery and cannot be returned for reasons of hygiene or health protection.”
Therefore, no right of withdrawal shall apply to medications* or products with a short shelf life (3 months) and to the specific preparations referred to in Article 19 herein.
*Medications: To prevent counterfeit medications or those not stored under the specified conditions from entering the supply chain, this exclusion of the right of withdrawal for medications was confirmed by the decree of June 20, 2013.
Similarly, no right of withdrawal shall apply, in particular, to the following PRODUCTS if they have been unsealed:
20.1. PREPARATIONS are compounded by the PHARMACY and are delivered sealed.
Due to their nature—in particular, the impossibility of reselling them if they are returned unsealed for health reasons—and in accordance with the provisions of Article L.221-28, PREPARATIONS are not subject to the right of withdrawal once unsealed and are governed by Article 19.2 of these Terms.
Consequently, the right of withdrawal applies under the conditions set forth in Article 19 of these Terms only to sealed PREPARATIONS.
20.2. Pursuant to the provisions of paragraph 3) of Article L.221-28 of the Consumer Code, SPECIFIC PREPARATIONS are “goods made to the consumer’s specifications or clearly personalized.” As such, SPECIFIC PREPARATIONS are not subject to any right of withdrawal.
All PRODUCTS offered on the SITE are covered by the warranty against hidden defects provided for in Articles 1641 et seq. of the Civil Code.
For items delivered in a defective condition, the USER is entitled to a warranty allowing them to return such items in accordance with Articles L.211-4 et seq. of the Consumer Code.
Pursuant to Article 3 of the Decree of December 18, 2014, it is hereby noted that when a consumer exercises their legal warranty of conformity:
The statutory warranty of conformity applies regardless of any commercial warranty that may have been provided.
